6 – The More I Studied Derek’s Financial Papers, the More I Understood Why His Sudden Interest in My Villa Had Frightened Me

I kept returning to the same question.

When had Derek begun making plans for my house?

I didn't have an answer.

Robert had the loan application in front of him.

The date on it was three months earlier.

That was all I could establish.

But I couldn't stop thinking about how much had happened since then.

Megan had come to my kitchen carrying the photocopied deed.

She had told me Derek had arranged the ownership.

She had explained that her parents needed the villa.

She had spoken as though the matter was settled.

Then the moving truck had arrived.

And Derek had behaved as though he had the right to decide whether I could stay in my own home.

Now I was looking at a loan application that predated those events.

I wasn't prepared to call the timing a coincidence.

But I wasn't prepared to claim more than I knew.

There was a difference.

I had to keep reminding myself of that.

Robert's office was quiet.

I could hear his papers moving as he referred to the application.

I watched his hands.

They were steady.

Mine had finally stopped trembling.

That didn't mean I felt better.

It meant I was beginning to understand how careful I needed to be.

I asked Robert to explain what the application actually established.

He returned to the sections we could verify.

Derek had identified himself as the owner of the Gulf Shores property.

He had stated its approximate value.

He had requested a substantial loan.

And the copy supplied by the lender contained a signature that appeared to be mine.

Those facts were on the paper.

What they didn't establish was how that signature had been placed there.

They didn't tell us who had written it.

They didn't tell us whether anyone else had been involved.

And they didn't tell us what Derek had been thinking.

I understood.

It would have been easier if the paper could explain everything.

It couldn't.

I looked at the amount again.

One hundred eighty thousand dollars.

I remembered sitting beside Derek on the porch.

The white-oak railing was only a few feet away.

Arthur's scratch was still visible near the corner.

Derek had admitted that his business was struggling.

Then I had asked about his debts.

He tried to avoid giving me a number.

I insisted.

Finally, he said he owed around eighty thousand dollars.

I remembered how still I had become.

That was a tremendous amount of money to hide from a spouse.

At least, Megan seemed not to have known.

Her reaction in the driveway had been painful to watch.

She had believed her husband when he said the business was doing well.

She had believed they could afford the renovations.

She had believed the villa belonged to him.

The trust documents had shattered that belief.

Then Robert had mentioned the loan.

And she had discovered another part of her husband's financial life that apparently hadn't been shared with her.

I felt sorry for her.

I also remained angry.

Those feelings could exist together.

Megan had helped turn my home into a place where her parents expected to live.

She hadn't checked whether I had agreed.

She hadn't questioned the deed Derek presented to her.

She had come to my kitchen and treated the transfer as an established fact.

That hurt.

But I could also see that Derek had misled her.

I didn't know what their marriage would become after that day.

The source of the immediate conflict was clear enough.

She had trusted what her husband told her.

He had told her things that the official records did not support.

That wasn't something I could repair for them.

I couldn't make Derek honest by explaining things more gently.

I couldn't remove Megan's disappointment.

And I couldn't give Ray and Donna a home merely to spare everyone the embarrassment of admitting a mistake.

I thought about Donna.

Her anger had been impossible to miss.

She had sold her dining room set.

She had given notice on the apartment.

She had paid for the moving arrangements.

Now she had to face the fact that the property was not available.

I knew she felt betrayed.

I had seen the tears in her eyes when she asked whether we could work something out.

She had appealed to the fact that we were family.

I had told her that being related did not give her the right to occupy my home.

I remembered how uncomfortable I felt saying it.

I had never enjoyed refusing someone who needed help.

I preferred being generous.

I preferred making people comfortable.

But the last three weeks had taught me that generosity could become a dangerous habit when nobody asked whether I wanted to give.

Ray and Donna had never received an invitation from me.

That fact mattered.

They had trusted Derek.

They had made decisions.

And those decisions had consequences.

I wished their situation had been different.

I still did.

But I wasn't responsible for creating a new home for them.

I looked down at the application.

The value of the villa seemed especially large beside the memory of Donna's furniture.

Eight hundred seventy-five thousand dollars.

I wondered whether Derek had looked at that value and begun imagining how many problems it might solve.

I couldn't know.

I had no right to turn speculation into fact.

But I could see why the property would have been attractive to someone struggling with debt.

The villa was valuable.

It was already built.

It was somewhere people wanted to live.

And I owned it.

That last point had apparently become inconvenient.

I thought about Derek's words on the porch.

He had expected me to remain in the apartment.

Permanently.

That had been his assumption.

He had not asked me whether I wanted to give up the villa.

He had simply decided that another place was good enough for me.

I hadn't been consulted about my own future.

That was the injury I kept coming back to.

I had built the villa with Arthur.

I had maintained it after his death.

I had preserved it through years of work.

And my own son had treated my right to remain there as a problem to be solved.

I looked at Robert.

I wanted to explain what that felt like.

But I wasn't sure how.

How did I tell an attorney that the hardest part wasn't the value of the property?

How did I explain that the gray curtains had upset me because they represented a life being erased?

How did I explain that a scratch in a railing mattered more to me than expensive furnishings?

I didn't need Robert to understand every memory.

He needed to protect my legal interests.

And he was doing that.

Still, I found myself thinking about the small things.

The porch swing.

The bedroom wall.

The roof.

Arthur's photograph.

I had placed the trust documents beside that photograph after Robert called.

I remembered standing at the dining table.

The papers were on one side.

Arthur's face was on the other.

For a moment, it seemed that those two things represented different kinds of protection.

Arthur had helped me build a home.

The trust helped establish that it remained mine.

Neither could protect me from the pain of what Derek had done.

But one of them had already prevented the house from being taken over as Derek intended.

I was grateful for that.

I thought about the day Robert presented the certified deed to the deputy.

He had explained that the villa was owned by my revocable living trust.

The deputy had checked the records.

Derek's name wasn't listed as owner.

It had been a simple fact.

But that fact changed everything.

Ray and Donna could no longer continue moving in as though they had a right to occupy the property.

Megan could no longer rely on Derek's photocopy as proof that he owned the house.

And Derek could no longer expect everyone to accept his claim without verification.

The recorded trust transfer had made the difference.

Six years earlier, I had protected the property.

At the time, I hadn't imagined I would need that protection against my own child.

I wouldn't have believed anyone who suggested it.

I had trusted Derek.

I had trusted him when he asked me to sign the quitclaim deed.

I had trusted him when he came to the house.

I had trusted him with the familiar freedoms that come from being family.

I didn't examine his every decision.

I didn't expect to need proof before believing him.

That was why seeing my signature on the application felt so devastating.

The paper suggested that somebody had been willing to create the appearance of my approval when I hadn't given it.

I couldn't say who.

Not yet.

But the existence of the document meant I had to treat the matter seriously.

I shifted in my chair.

Robert looked toward me.

I asked whether the original documents would help establish how the application had been prepared.

He explained that obtaining the supporting paperwork was part of the review.

The signature examination would be another part.

I nodded.

I didn't pretend to understand every technical detail.

I only wanted to know that the question would be investigated properly.

I was no longer willing to rely on assumptions.

There had already been too many.

Derek assumed I would live permanently in the apartment.

Megan assumed he had completed the transfer.

Ray and Donna assumed the villa was available.

And I had assumed my son would never use my property without asking me.

Everyone had made assumptions.

But they had not all carried the same consequences.

Theirs had left a moving truck in my driveway.

Mine had left me sitting in an attorney's office, wondering whether my name had been used without permission.

I thought about that for a long time.

I had spent years telling myself Derek was a good son who sometimes needed extra help.

I still wanted to believe there was goodness in him.

I hadn't stopped loving him.

But love couldn't change a recorded deed.

It couldn't change the amount he had written on a loan application.

It couldn't change the fact that he had claimed ownership of property that belonged to my trust.

And it couldn't transform an unauthorized signature into an authorized one.

I knew that.

The problem was accepting it emotionally.

I had spent so many years defending Derek that I almost felt disloyal examining his actions.

That feeling embarrassed me.

He was forty-one.

He had been married.

He ran a business.

He was responsible for his decisions.

And yet I still felt the old impulse to protect him from consequences.

I had to acknowledge that impulse without obeying it.

I looked toward Robert's folder.

The papers weren't accusations by themselves.

They were records.

They contained claims that could be checked.

That was what made them important.

I didn't want to punish my son for disappointing me.

I wanted to establish whether he had used my name without consent.

Those were different goals.

I needed to keep them separate.

For a moment, I remembered Derek sitting beside me on the porch swing.

He hadn't understood why I was resisting.

He had expected me to accept his explanation.

He had said he didn't mean to hurt me.

I believed it was possible he hadn't wanted to see me suffer.

But that didn't excuse the suffering he had caused.

People could do terrible damage while insisting they never intended harm.

I had finally learned that.

I lowered my eyes to the application again.

Three months earlier.

A property value of approximately eight hundred seventy-five thousand dollars.

A request for one hundred eighty thousand dollars.

Derek's ownership claim.

My signature.

I repeated those facts silently.

They were enough.

I didn't need to invent a motive.

I didn't need to decide who had written the signature before an examiner reviewed it.

I didn't need to accept Derek's explanation simply because he was my child.

I needed the truth.

And I needed to be strong enough to accept it, even if it showed that my son had been planning around my property long before the confrontation in the driveway.

<a
