Ivers Revocable Living Trust.

I was Vivien A. Ivers.

I was also the trust's only trustee and beneficiary.

The property had been placed into that trust six years earlier.

The transfer had been officially recorded.

Robert took out a certified deed and handed it to the deputy.

The deputy looked through it.

Then he looked at Derek.

"According to this, you aren't the owner."

Derek gave a short laugh.

It was the kind of laugh people make when they want everyone to believe a problem is nothing serious.

"Mom gave it to me before that," he said.

Robert didn't argue.

He simply turned toward him.

"Do you have the recorded transfer showing that?"

Derek reached into his jacket.

I knew what he was going to produce before I saw it.

The same photocopied deed Megan had presented to me a week earlier.

I had already seen that paper.

I had already seen how certain she was that it settled everything.

Watching Derek hold it out to the deputy, I felt something unexpected.

Not satisfaction.

Sadness.

My son was relying on a piece of paper to justify pushing me out of my own home.

And he still seemed convinced that I would be the one forced to give way.

The deputy studied the photocopy.

He turned it over.

Then he looked toward Robert.

Robert explained that the paper was an unrecorded quitclaim deed.

There was no recorded transfer establishing Derek as the current owner.

The official records instead showed the property had been transferred into my trust.

I watched Derek's expression change.

Only slightly.

His mouth tightened.

His shoulders seemed to lose some of their certainty.

I had seen him look that way as a boy when a plan hadn't worked.

Back then, I would have asked what was wrong.

I would have looked for some way to help.

That morning, I stayed where I was.

Ray Proctor stepped closer.

He looked from Robert to Derek.

"Are you saying we brought all our stuff here without actually knowing who owned the house?"

Robert looked at him.

He explained that the ownership should have been confirmed before Ray and Donna ended their lease and made arrangements to move.

Ray turned toward Derek.

"You said this place was yours."

Derek started to answer.

Then he stopped.

The silence lasted only a few seconds.

It felt much longer.

Donna stood beside her husband with one hand pressed against her chest.

She looked genuinely shaken.

"We got rid of our dining room furniture," she said. "We gave notice on the apartment. We spent money on that truck."

She looked directly at Derek.

"You said there wasn't a problem."

I listened without interrupting.

They had arranged their lives around a house I had never offered them.

They had made their plans.

They had packed.

They had even started changing things inside.

But nobody had asked me whether I wanted to surrender my home.

Not one of them.

Megan was staring at her husband.

"Derek, you told me your mother had already transferred it."

He didn't offer her a convincing answer.

I remembered the certainty with which she had spoken to me when she brought that photocopy into my kitchen.

There hadn't been any hesitation then.

She had treated the matter as finished.

Her parents needed the house.

Derek had supposedly arranged everything.

My feelings were not part of the conversation.

Standing there now, I wondered whether she understood what she had helped do.

I couldn't know.

I only knew what I had heard and seen.

I thought about the gray curtains that had appeared in my bedroom.

I thought about the coral paint I had chosen being covered.

I thought about strangers deciding what should happen to rooms filled with Arthur's memory.

My throat tightened.

I turned toward the house because I didn't want Derek to see it.

For twenty years, I had tried to be the person who made life easier for him.

I had never wanted him to suffer.

I had never wanted to humiliate him.

Even that morning, with everything happening in front of the neighbors, I wasn't enjoying his discomfort.

That is difficult to admit.

Part of me had expected I would feel victorious if Robert proved I still owned the villa.

Instead, I felt exhausted.

The truth was finally being spoken.

But it didn't change the fact that my son had been willing to remove me from the place I loved.

Then Derek approached me.

"Mom, could we speak somewhere alone?"

I looked at him.

For a moment, I saw the little boy I remembered.

The boy whose bicycle I repaired.

The boy who sat beside me struggling with schoolwork.

The boy who had depended on me when his marriage ended.

I wanted that boy to be standing there.

But he wasn't.

He was a grown man who had told his mother she could no longer stay in her own home.

"We could have talked about this a long time ago," I said.

He glanced toward the neighbors.

"Please, Mom. Not with everyone watching."

That made me look at him more carefully.

He seemed embarrassed.

Not especially concerned about what I had been through.

Embarrassed.

I remembered the way he had told me I wasn't welcome anymore.

He hadn't protected me from that humiliation.

He hadn't considered whether it would hurt to hear it.

But now he wanted privacy.

"That didn't bother you when you told me I had to leave," I said.

He lowered his voice.

"You're making me look bad."

I felt that sentence settle somewhere deep inside me.

I had expected anger.

I had expected excuses.

I had even expected him to blame Megan or her parents.

What I hadn't expected was for him to make his embarrassment the important thing.

I looked at the driveway.

The moving truck was still there.

The family that had planned to take over my home was standing beside it.

And Derek was concerned about how he looked.

I couldn't think of anything useful to say.

Robert gently touched my arm.

He suggested that we let the deputy finish addressing the situation.

I nodded.

The deputy made it clear that the documents Derek had presented did not establish any right for him or the Proctors to occupy my villa.

He advised them not to continue bringing their belongings into the house while the ownership and possession issues were being resolved.

Robert handed him a written notice.

It came from the attorney representing my trust.

The notice requested that the people occupying the property without authorization leave and stop interfering with my possession of it.

The deputy read it.

Then he addressed everyone.

He told us the situation needed to remain peaceful.

Nobody should damage the house.

Nobody should take my property.

Any remaining dispute about the documents or the right to occupy the villa had to be handled through the proper legal process.

I was grateful for his calmness.

The situation had already become painful enough.

I didn't want shouting.

I didn't want anyone damaging the rooms Arthur and I had worked on.

I wanted the people who had never been invited to stop treating my home as theirs.

Ray rubbed his forehead.

He looked tired.

"Then where are we supposed to live?"

His question hung between us.

I could see why he was frightened.

He and Donna had already ended their lease.

They had packed their lives into a truck.

They had sold furniture.

They thought they were moving into a permanent place.

Now they were being told that the house was not Derek's to offer.

For a brief moment, I felt myself preparing to solve their problem.

It was an old habit.

Someone was upset.

Something had gone wrong.

I wanted to make it better.

Then I looked at my front door.

I remembered how they had spoken about my furniture and my bedroom.

They had behaved as though I had already disappeared.

I had never agreed to any of it.

"I'm sorry you've been put in this position," I told Ray. "But I never offered you this house."

Donna looked at me.

Her eyes were beginning to fill.

"Vivien, there must be something we can arrange. We're related now."

I understood what she wanted.

She wanted the word family to change my answer.

I had used that same word to excuse more things than I cared to count.

But I couldn't do it again.

"Being related doesn't give anyone permission to take another person's home."

Donna looked away.

I didn't feel good saying it.

I wished I had never needed to.

I wished Derek had been honest with his wife.

I wished Megan had asked me before announcing that her parents would move in.

I wished Ray and Donna had understood that a house belonged to a living person who still wanted to live there.

But wishes weren't going to change the ownership records.

And they weren't going to change what had happened.

For the first time that morning, I began to believe the villa might remain mine in more than just a legal sense.

I might actually be allowed to stay in it.

I might be able to walk into my bedroom without finding another person's belongings.

I might be able to sit on the porch swing without feeling like an unwelcome visitor.

Robert began gathering the papers.

I thought he was finished.

Then he looked toward Derek.

His expression was serious.

"There's another issue we need to address."

I watched him remove several printed pages from the folder.

Derek stopped moving.

Robert looked down at the pages.

Then he said that Derek had apparently identified my villa as an asset in a loan application.

I turned toward my son.

He had gone very quiet.

The deed had settled one question.

The papers in Robert's hand had just raised another.

Click here to continue reading: PART 2: While My Son Tried to Explain Away His Loan Application, I Found Myself Remembering Everything I Had Given Him

I had spent most of my life believing my son would never deliberately hurt me.
